1. General information

These General Terms and Conditions govern the purchase of products offered on the website https://36mood.com, owned by:

Placing an order implies full and unreserved acceptance of these General Terms and Conditions as published at the time of the order.

2. Scope

36mood.com is an online store specialising in radio-controlled products. Through this website, users may purchase products subject to these terms, which are governed by applicable Spanish and European legislation, in particular Royal Legislative Decree 1/2007 approving the Consolidated Text of the General Law for the Defence of Consumers and Users (TRLGDCU) and Law 34/2002 on Information Society Services (LSSI-CE).

3. Purchase process and order confirmation

To place an order, the user must follow the steps indicated on the website: select products, add them to the cart, enter delivery and payment details, and confirm the order.

Once the order is completed, the user will receive a confirmation email with a summary. This confirmation does not constitute definitive acceptance of the order, which is subject to product availability and payment verification.

If a product is unavailable after the order is placed, the user will be informed and a full refund will be issued as soon as possible.

36mood.com reserves the right to reject an order for justified reasons, in which case the user will be notified and any amount charged will be refunded.

4. Prices

All prices shown on the website are in euros and include applicable VAT. Shipping costs are not included in the product price and will be shown separately before order confirmation.

36mood.com reserves the right to modify prices at any time. Products will be invoiced at the price in force at the time the order is placed.

5. Payment methods

The following payment methods are accepted:

  • Credit or debit card: via the secure Redsys payment gateway with SSL encryption.
  • PayPal: via redirection to the secure PayPal platform.
  • Bank transfer: bank details will be provided upon order confirmation. The order will be processed once payment has been verified.

36mood.com does not store card details. All card payments are processed entirely through the Redsys gateway.

6. Shipping and delivery times

All orders are shipped via GLS. Estimated delivery times and rates are as follows:

Delivery times are estimates and may be affected by circumstances beyond 36mood.com's control. The delivery period begins from payment confirmation.

The user will receive an email with a tracking number once the order has been dispatched.

In the event of damage or loss during transport, the user must notify us at info@36mood.com within 24 hours of receiving the package.

7. Right of withdrawal

In accordance with Article 102 of the TRLGDCU, the user has the right to withdraw from the contract within 14 calendar days without giving any reason.

The withdrawal period expires 14 calendar days from the day the user, or a third party other than the carrier designated by the user, takes physical possession of the goods. For orders with multiple items delivered separately, the period begins from receipt of the last item.

7.1 How to exercise the right of withdrawal

To exercise the right of withdrawal, you must inform us of your decision by an unequivocal statement before the deadline expires. You may do so by sending an email to info@36mood.com including your name, order number and your intention to withdraw.

You may use the following model withdrawal form, although its use is not mandatory:

To meet the withdrawal deadline, it is sufficient for the communication to be sent before the deadline expires.

7.2 Return shipping costs

The direct costs of returning the goods shall be borne by the customer, unless expressly stated otherwise at the time of purchase or in the order confirmation.

7.3 Refund

In the event of withdrawal, 36mood.com will reimburse all payments received, including original delivery costs (except for additional costs arising from the choice of a delivery method other than the standard one), without undue delay and no later than 14 calendar days from the date we are informed of the withdrawal decision.

The refund will be made using the same payment method used for the original transaction. 36mood.com may withhold the refund until the returned products have been received or until the user provides proof of return.

The user must return the goods without undue delay and in any event no later than 14 calendar days from the date of the withdrawal communication.

8. Exceptions to the right of withdrawal

In accordance with Article 103 of the TRLGDCU, the right of withdrawal does not apply to:

  • Personalised products or those made to the user's specifications.
  • Products that may deteriorate or expire rapidly.
  • Sealed products that are not suitable for return due to health or hygiene reasons and have been unsealed after delivery.
  • Services that have been fully performed with the user's express consent.

9. Returns conditions

Returned products must be in the same condition as delivered, unused beyond initial inspection, and include all original packaging, instructions and documentation.

Returns will not be accepted for products that have been used, damaged or that do not retain their original packaging.

10. Legal guarantee

All products sold on 36mood.com are subject to the legal conformity guarantee of 2 years from delivery, in accordance with Royal Legislative Decree 1/2007 (TRLGDCU) and Directive (EU) 2019/771.

If the product presents a lack of conformity, the user may request repair, replacement, a price reduction or contract termination, under the terms provided by applicable regulations.

To make a warranty claim, please contact us at info@36mood.com with your order number and a description of the defect.

11. Liability

36mood.com is not liable for the improper use of purchased products. Radio-controlled products may be subject to usage restrictions in certain spaces or circumstances; it is the user's responsibility to be aware of and comply with applicable regulations in their country or region.

12. Dispute resolution

In accordance with EU Regulation 524/2013, we inform you of the existence of the European Online Dispute Resolution platform, available at: https://ec.europa.eu/consumers/odr/. Through this platform you may submit a complaint if you have been unable to resolve your issue directly with us.

13. Applicable law and jurisdiction

These General Terms and Conditions are governed by Spanish law. For the resolution of any dispute, the parties submit to the courts of the user's place of residence, in accordance with consumer protection regulations.
